Pro) will be charged once the Client provides full
confirmation to start the project. This fee covers the efforts
and resources invested by our dedicated web team in
initializing the project. (b) The set-up fee will be
communicated to the Client before the project initiation and
is due upon receipt of the payment link provided via email.
Recurring Subscription Fee:

a) The recurring subscription fee will be charged for the
selected plan (Basic, Standard, Pro) once the website is live
and accessible on the internet. (b) This fee covers the
ongoing maintenance, support, hosting services, and all other
plan specific features provided by Econobyt to keep your
website running smoothly and efficiently. (c) The first
recurring subscription fee will be charged after the
successful launch of the website.
Payment Link:
(a) Upon receiving the Client's full confirmation to proceed
with the project, we will provide a secure payment link via
email for the set-up fee. (b) The payment link will allow the
Client to conveniently make the required payment using various
payment methods, ensuring a hassle-free transaction.
Payment Confirmation and Project Initiation: (a) Once the
payment for the set-up fee is received and confirmed, our web
team will initiate the project promptly. (b) The Client will be
informed of the project initiation and receive regular updates
throughout the development process.
Recurring Subscription Commencement: (a) The recurring
subscription fee will commence once the website is launched and
made publicly accessible on the internet. (b) This ensures that
the Client is charged only for the services received and allows
for a smooth transition from development to active website
maintenance.
Payment Security: (a) Econobyt takes data security seriously.
All payment transactions will be processed through secure
payment gateways to protect the Client's financial information.
(b) Any sensitive payment data will be encrypted and handled in
accordance with industry standards and data protection
regulations.
At Econobyt, we believe in transparency and aim to provide
excellent customer service throughout the payment process.
Should the Client have any questions or concerns regarding the
payment terms, our team is readily available to address them
promptly.
Refund Policy
We are committed to providing a fair and transparent refund
policy for our valued clients. Please carefully review the
following terms and conditions regarding refund requests:
Requesting a Refund: (a) If the Client wishes to request a
refund, they must reach out to us via email or live chat channel
and provide complete details regarding the reason for the refund
request. (b) We encourage open communication to understand and
address the Client's concerns promptly.
Non-Refundable One-Time Setup Fees: (a) One-time setup fees are
non-refundable. These fees cover the significant efforts and
resources invested by our talented website designers and
developers in initiating the project. (b) The setup fee is
charged once the Client provides full confirmation to proceed
with the project.
Refund Scenarios for One-Time Setup Fees: (a) In the event that
the web team has already started the project, and the Client
decides to cancel suddenly for any reason, the one-time setup
fee is non-refundable. (b) The only scenario in which a refund
for the one-time setup fee will be considered is if we fail to
complete the project within 14 days after receiving the payment
for the setup fee. (c) The project is considered finished once
we forward the project preview to the Client and request
approval to push it live. (d) Any adjustments or revisions
requested by the Client after the initial website preview won't
count towards the 14-day time frame for refund eligibility.
Refund Process and Timing: (a) Once a refund request is received
and reviewed, we will communicate our decision to the Client in
a timely manner. (b) If the refund request meets the eligibility
criteria as outlined in our refund policy, the refund amount
will be processed and returned to the original payment method
used by the Client within a reasonable timeframe. (c) The refund
processing time may vary depending on the payment method and
financial institution, and the Client will be notified of any
estimated refund timelines.
Exemptions from Refund Policy: (a) Our refund policy does not
cover changes to the project scope or customization requests
made by the Client during the development process. (b) Any
delays caused by the Client's failure to provide necessary
materials, content, or approvals within the agreed-upon timeline
may affect the project's completion and are exempt from the
refund policy.
Commitment to Client Satisfaction: (a) At Econobyt, we are
committed to ensuring the Client's satisfaction with our
services. If the Client encounters any issues during the
project, we encourage them to reach out to our team to seek
resolution promptly.
Changes to the Refund Policy: (a) Econobyt reserves the right to
modify or amend this refund policy at any time. Clients will be
notified of any changes, and the revised policy will apply to
any refund requests received after the modification date.

The Client must approve the content before it is published on
the website, ensuring accuracy, completeness, and compliance
with any legal requirements.
Prompt and Clear Communication: (a) Open and timely
communication is essential for a successful project. The Client
agrees to respond promptly to inquiries, requests for feedback,
or any other communication related to the website building
project. (b) In case of any changes or revisions during the
development process, the Client shall provide clear instructions
to avoid misunderstandings and ensure accurate implementation.
Meeting Agreed Deadlines: (a) The Client shall adhere to
mutually agreed-upon deadlines for providing information,
feedback, and approvals during the project's lifecycle. (b)
Timely responses from the Client are vital to maintaining the
project's progress and meeting the anticipated completion date.
Cooperation During Testing and Review Phases: (a) The Client
agrees to cooperate during the testing and review phases of the

The Client's active participation during this phase ensures a

Providing Hosting and Domain Access:
(a) If the Client already has an existing hosting and domain
service, it is highly recommended, though not required, to
provide Econobyt with access credentials to ensure a smooth
and fast website launch process.
(b) Econobyt respects the security and privacy of the Client's
information and guarantees that access credentials will be
handled with the utmost confidentiality and used solely for
the purpose of deploying the website.
(c) If the Client chooses not to provide direct access, an
alternative solution is to delegate access to Econobyt. This
allows Econobyt to perform necessary tasks without having
access to sensitive information or account details.
(d) Alternatively, the Client may transfer the domain under
Econobyt's management, in which case Econobyt will assume
responsibility for managing and renewing the domain on behalf
of the Client. We prioritize security and data privacy, and we
understand that granting access to hosting and domain services
is a decision that requires careful consideration. We assure
our clients that we take all necessary precautions to protect
their information and use access credentials responsibly to
ensure a seamless and efficient website launch.

SEO and Keyword Considerations: (a) Search Engine Optimization
(SEO) plays a vital role in driving organic traffic to your
website. The Client is encouraged to provide relevant keywords
or phrases related to their business for integration into the
content. (b) Econobyt will employ SEO best practices to optimize
the content and improve its visibility in search engine results.
Visual Content Integration: (a) Engaging visual elements, such
as images, graphics, and videos, enhance the overall appeal and
user experience of a website. The Client is welcome to provide
visual assets to be incorporated into the content. (b) Econobyt
can assist in sourcing relevant stock images or creating custom
graphics to complement the content, ensuring a visually
captivating website.
Content Review and Approval: (a) The Client will have the
opportunity to review the website content before it is
published. Econobyt encourages the Client to provide timely
feedback and approval to avoid delays in the website development
process. (b) Any necessary revisions or adjustments to the
content will be addressed promptly to ensure the content aligns
with the Client's expectations.
Compliance with Legal and Ethical Standards: (a) The Client
shall ensure that the content provided complies with all
applicable legal and ethical standards, including copyright and
intellectual property rights. (b) Econobyt is committed to
upholding these standards and may refuse to include content that
violates any laws or infringes on the rights of third parties.

professional and visually appealing website, tailored to the
client's brand identity and objectives. (c) Unlimited Website
Edits: Clients can make unlimited content edits to their
website, allowing them to keep their content up-to-date without
any additional charges. (d) Web Team Support: Our dedicated web

Contact & Lead Generation: Basic tier clients will have

protect your data and ensure it is not disclosed to unauthorized

Original Works and Copyrights: (a) Any original works of
authorship created by our team, including website designs and
custom graphics, are the property of Econobyt. (b) We grant you
a non-exclusive, royalty-free license to use these original
works solely for the operation and promotion of your website.
Third-Party Copyrights and Intellectual Property: (a) Econobyt
assures the client that any content, including images, graphics,
or other materials, added to the website, which was not directly
provided by the client, is either royalty-free, licensed for
commercial use, or created in-house by Econobyt's team of
designers and developers. (b) We take great care to ensure that
all content used in the website development process complies
with copyright laws and respects the intellectual property
rights of third parties.
Transfer of Website Ownership: (a) Upon project completion and
full payment of our services, the client will become the sole
owner of the website we developed for them, including all
intellectual property rights related to the design, code, and
content. (b) To facilitate the transfer process and ensure a
seamless transition, a one-time transfer fee will be applied.
(c) The transfer fee covers the administrative and technical
tasks involved in transferring ownership rights, preparing the
necessary documentation, and facilitating the handover of all
website assets to the client. (d) This fee is a standard
industry practice and reflects the time and effort invested in
preparing and processing the transfer, ensuring that the client
gains full control and ownership of their website without any
future obligations or liabilities to Econobyt.
Non-Disclosure Agreement (NDA): (a) To further protect your
intellectual property and proprietary information, Econobyt is
open to signing a Non-Disclosure Agreement (NDA) with you upon
request. (b) The NDA ensures that all information shared between
both parties remains confidential and is not disclosed to third
parties.

original works of authorship created by our team during the
development process, subject to the license granted to the

Dispute Resolution: (a) If any disputes arise regarding the
cancellation of the project or related matters, both parties
agree to engage in good faith negotiations to resolve the issue
amicably. (b) If a resolution cannot be reached through
negotiations, the parties agree to seek mediation or arbitration
to settle the dispute.

projects, in the event it does happen, we are committed to
refunding the set-up fee to the client and providing a thorough
explanation.
Automatic Cancellation due to Payment Non-Receipt:

service for our clients with active subscriptions. To ensure a
consistent and hassle-free experience, we have implemented an
automatic cancellation policy in the event of non-receipt of
payments from clients with active monthly subscriptions. Here
are the details of this clause:
Automatic Cancellation: (a) This clause is applicable only to
clients who have an active subscription with Econobyt and are
making monthly payments for the service. (b) If we fail to
collect payment from the client within one week after the
payment due date, the subscription will be automatically
canceled.
Payment Reminder Notifications: (a) Prior to the automatic
cancellation, Econobyt will make reasonable efforts to notify
the client about the outstanding payment. (b) Payment reminder
notifications will be sent via email or other electronic
communication methods provided by the client.
Grace Period and Reinstatement: (a) The one-week period after
the payment due date will act as a grace period during which the
client can make the outstanding payment to avoid cancellation.
(b) If the client makes the payment during the grace period, the
subscription will be reinstated, and services will continue as

Reapplication and New Subscription: (a) In the event of
automatic cancellation, the client can reapply for a
subscription with Econobyt at any time. (b) A new subscription
will be subject to availability, current pricing, and the
acceptance of the latest terms and conditions.
Data and Content Retention: (a) Upon automatic cancellation, the
client's website data and content will be retained by Econobyt
for a specified period, as mentioned in the terms of service.
(b) The client will have the option to request a data backup
during the retention period.
Dispute Resolution: (a) In the event of any dispute regarding
the automatic cancellation due to payment non-receipt, both
parties agree to engage in good faith negotiations to resolve

parties agree to seek mediation or arbitration to settle the

Financial and Business Impact: (a) Econobyt will not be liable
for any financial losses, lost profits, or business
interruptions resulting from the use or inability to use our
services. (b) Clients are responsible for conducting their due
diligence and assessing the potential impact of their website on
their business.
Indemnification: (a) Clients agree to indemnify and hold
Econobyt and its team members harmless from any claims,
liabilities, damages, or expenses arising from the use of our
services. (b) This includes, but is not limited to, claims
related to content, copyright infringement, and third-party
services.
Maximum Liability: (a) In the event that Econobyt is found
liable for any damages, our maximum liability shall not exceed
the total fees paid by the client for the specific services
rendered.

limitations of liability, both parties agree to engage in good

resolution cannot be reached through negotiations, the parties

Exclusive Jurisdiction: (a) Any legal disputes or claims arising
from the website building services provided by Econobyt shall be
subject to the exclusive jurisdiction of the courts in the
United States of America. (b) For clients residing outside the
USA, both parties agree to submit to the personal jurisdiction
of the courts in the USA for the resolution of any such disputes
or claims.
International Arbitration: (a) In the event of any disputes or
disagreements arising from the services provided by Econobyt,
both parties shall first attempt to resolve the matter amicably
through good faith negotiations or mediation. (b) If the dispute
remains unresolved through mediation, both parties agree to
submit to binding arbitration conducted in accordance with the
rules and procedures of a recognized international arbitration
organization, mutually agreed upon by both parties.
Language of Agreement: (a) The official language of these terms
and conditions, as well as all communications and documents
related to the website building services, shall be in English.
